Official Rules

The Pie in the Sky Contest (the "Contest") is sponsored by [TBD: legal entity name], with a principal place of business at [TBD: mailing address] ("Sponsor"). The Contest is not sponsored, endorsed, or administered by Apple Inc., Google LLC, or any gift-card issuer.

The Contest is a skill-based event. Participants compete by capturing and submitting graded clouds in the Whimsy Cloud mobile application during the Contest Period. Rankings are determined solely by cumulative Contest score under the scoring rules in Section 6. Chance does not determine winners.

Duration: one (1) week. Exact start and end times: [TBD: start date/time and end date/time, including time zone, e.g. 12:00 a.m. PT on DATE through 11:59 p.m. PT on DATE] (the "Contest Period").

Open to individuals who, as of the start of the Contest Period:

• Are at least eighteen (18) years of age (or the age of majority in their jurisdiction of residence, if higher);
• Are legal residents of [TBD: e.g. the fifty United States and D.C., excluding Rhode Island / or list allowed countries];
• Have a free Whimsy Cloud account and have reached Level 1 or higher through ordinary free gameplay (no purchase required to reach Level 1 or to enter); and
• Are not employees, officers, or directors of Sponsor, or of its agencies or immediate family members / household members of the same, unless Sponsor expressly permits otherwise in writing.

Void where prohibited by law. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final on all matters relating to the Contest.

No purchase or payment is necessary to enter or win. A purchase will not improve your chances of winning. Creating a free Whimsy Cloud account, downloading the free Whimsy Cloud app (where available), and capturing graded clouds during the Contest Period are sufficient to enter, provided you meet the eligibility requirements above. Paid Pro subscriptions, stickers, or other in-app purchases are not required to participate or to maximize score under the Contest scoring rules.

1. Download or open the Whimsy Cloud app and sign in with an eligible account that is Level 1 or higher.
2. During the Contest Period, capture and submit clouds that receive a grade under Whimsy Cloud's ordinary grading system.
3. Each eligible graded capture that counts toward Contest scoring will be recorded automatically against your account. No separate entry form is required unless Sponsor announces otherwise in-app or on this site.

Limit: one Whimsy Cloud account per person. Multiple accounts, bots, scripts, or any attempt to manipulate scoring or rankings may result in disqualification.

Rankings are based on cumulative Contest score earned during the Contest Period only. Scoring method: [TBD: exact formula — e.g. sum of grade points for each eligible cloud capture; what counts as "graded"; caps per day; whether duplicates / low-quality / rejected captures are excluded].

At the end of the Contest Period, eligible entrants are ranked from highest to lowest Contest score. Prizes are awarded in rank order as described in Section 7. Ties: [TBD: tie-breaker — e.g. earliest time the tying score was reached, then highest single-capture grade, then random draw among remaining tied entrants solely to break the tie].

Sponsor reserves the right to audit captures, grades, and accounts and to adjust rankings or disqualify entrants for fraud, abuse, or violation of these rules or Whimsy Cloud's terms of use.

Subject to verification of eligibility and compliance with these Official Rules, prizes will be awarded as follows:

• Ranks 1–3 (3 winners): each receives one (1) One Hundred Dollar ($100) gift card [TBD: retailer / issuer], one (1) one-year Whimsy CloudPro subscription, and one (1) free cloud sticker. Approximate Retail Value ("ARV") per winner: [TBD: $100 + Pro ARV + sticker ARV].
• Ranks 4–8 (5 winners): each receives one (1) one-year Whimsy Cloud Pro subscription and one (1) free cloud sticker. ARV per winner: [TBD].
• Ranks 9–18 (10 winners): each receives one (1) one-month Whimsy Cloud Pro subscription and one (1) free cloud sticker. ARV per winner: [TBD].
• Ranks 19–68 (50 winners): each receives one (1) free cloud sticker. ARV per winner: [TBD].

Total number of prize winners: up to sixty-eight (68). Total ARV of all prizes: [TBD: sum of all ARVs]. Gift cards and subscriptions are subject to the issuer's or Sponsor's terms. No cash alternative, substitution, or transfer except at Sponsor's sole discretion. Any difference between stated ARV and actual value will not be awarded. Winners are solely responsible for any federal, state, and local taxes.

Potential winners will be notified within [TBD: e.g. seven (7) days] after the Contest Period ends via the email associated with theirWhimsy Cloud account and/or in-app notice. Potential winners may be required to complete an affidavit of eligibility, liability release, and (where lawful) publicity release, and to provide a valid mailing or digital delivery address, within [TBD: e.g. ten (10) days] of notice. Failure to respond, or return of prize notification as undeliverable, may result in forfeiture and award to the next eligible runner-up.

For prizes valued at $600 or more in a calendar year (or as otherwise required by law), Sponsor may require a completed IRS Form W-9 before prize fulfillment.

Except where prohibited, acceptance of a prize constitutes permission for Sponsor to use the winner's first name, city and state of residence, likeness, and Contest-related comments for promotional purposes in any media without further compensation or notice.

Sponsor reserves the right to cancel, suspend, or modify the Contest if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor is not responsible for late, lost, incomplete, or misdirected entries; app or network failures; or scoring errors caused by factors outside Sponsor's reasonable control. By participating, entrants release and hold harmless Sponsor and its affiliates, officers, directors, employees, and agents from any claims arising out of participation or receipt / use of any prize, to the fullest extent permitted by law.

Except where prohibited, all issues arising out of these Official Rules or the Contest shall be governed by the laws of [TBD: e.g. the State of California], without regard to conflict-of-law rules, and resolved exclusively in the courts located in [TBD: county / venue]. Entrants waive any right to a jury trial and to participate in a class action to the extent permitted by law.
