Terms of Use

1. Who we are

The Services are operated by Whimsy Cloud("we," "us," or "our"). Contact: support@whimsycloud.app. Legal entity name and mailing address may be updated here when finalized.

2. Eligibility

You must be at least 13 years old (16 in the EU/EEA/UK where required) to join the waitlist or create an account. Some features — including events that offer cash prizes — require that you are 18 or older and may ask for your birthday. You are responsible for complying with laws where you live.

3. Accounts

You may need an account to use the app. Provide accurate information, keep your login secure, and tell us promptly if you suspect unauthorized access. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk for other users or the Services.

4. The Services

Whimsy Cloud is a cloud-hunting game. Features may include capturing outdoor sky photos, AI-assisted grading, saving finds to a collection, energy-limited grading attempts, friendly matches and events, optional ads, and optional in-app purchases (such as Pro or energy/storage packs). Features may change, be limited during beta, or differ by platform.

Photos submitted for grading must be of the real outdoor sky. Screenshots of screens, books, or other non-sky sources may be rejected. Do not upload unlawful, harmful, or infringing content.

5. Virtual goods, energy, and subscriptions

Energy, collection slots, Pro entitlements, stickers, and similar items are virtual goods with no cash value outside the Services unless we expressly say otherwise (for example, a separately announced contest prize). Purchases are processed by Apple, Google, or other payment processors under their terms. Except where required by law or store policy, purchases are non-refundable through us. Unused virtual goods may be lost if your account is terminated for cause or if we discontinue a feature with reasonable notice where practicable.

6. Contests and promotions

Skill contests (including The Pie in the Sky Contest) and other promotions are governed by their own official rules when published. Those rules control if they conflict with these Terms. Draft rules on this site are planning documents until finalized. No purchase is required to enter skill contests unless the official rules clearly state otherwise in a lawful way.

7. Acceptable use

You agree not to:

• Cheat, automate, scrape, or manipulate grading, scores, matches, or events
• Create multiple accounts to gain an unfair advantage
• Harass others, abuse support channels, or disrupt the Services
• Reverse engineer or interfere with the app, APIs, or infrastructure except as allowed by law
• Use the Services for any unlawful purpose

8. Intellectual property

The Services, branding, and related materials are owned by us or our licensors. You retain rights in photos you capture, and you grant us a limited license to host, process, display, and use them as needed to operate grading, collection, matches, events, support, and safety features. Feedback you send may be used to improve the Services without obligation to you.

9. Disclaimers

The Services are provided "as is" and "as available." Beta features may be unreliable. We do not warrant uninterrupted access, perfect grading accuracy, or that the Services will meet your expectations. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Whimsy Cloud and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services will not exceed the greater of (a) amounts you paid us for the Services in the 12 months before the claim or (b) USD $50. Some jurisdictions do not allow certain limitations; in those places, limits apply to the maximum extent allowed.

11. Privacy

Our Privacy Policy explains how we collect and use personal information.

12. Changes and termination

We may update these Terms by posting a new version with a revised "Last updated" date. Continued use after changes means you accept the updated Terms. You may stop using the Services at any time. You may request account deletion via support@whimsycloud.app or in-app settings where available.
